Terms of Service

Welcome to our crewing platform (the “Platform” or “Service”). The Platform (Crew.Sea-Man.Org) connects seafarers (“Seafarers”) who upload CVs and supporting documents with maritime employers (“Employers”) who post vacancies. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Crew.Sea-Man.Org (“we”, “us”, “our”).

1. General Provisions

We operate an online crewing marketplace that enables Seafarers to create profiles and upload documents and Employers to publish job openings. By registering an account, uploading any content, or otherwise using the Platform, you expressly accept and agree to be bound by these Terms. If you do not agree, you must not register or use the Platform.

2. Registration and Account

To register and use the Platform as a Seafarer, you must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a binding contract. You represent and warrant that all information you provide during registration and when uploading your CV or documents is true, accurate, current, and complete. You agree to update your information promptly if it changes. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content / Contributions

All CVs, scanned documents, certificates, photos, and any other materials you upload or submit (“User Content”) remain your property.

Rights

You retain all rights, title, and interest in your User Content. By posting or uploading User Content to the Platform, you grant us a non-exclusive, royalty-free, worldwide, irrevocable, and sublicensable license to store, reproduce, display, transmit, and distribute your User Content solely to potential Employers and for the purpose of operating and providing the Service.

Responsibility

You bear full and sole responsibility for the legality, accuracy, truthfulness, and content of your User Content. You represent and warrant that you own or have all necessary rights and permissions to upload and share your User Content, including any personal data contained in scans of documents or certificates, and that such sharing complies with all applicable data-protection and privacy laws.

Vacancies

Employers who post vacancies on the Platform represent and warrant that every vacancy is genuine, lawful, accurately described, and posted in good faith. We do not independently verify vacancies but reserve the right to remove any posting that we reasonably believe violates these Terms or applicable law.

Disclaimer of Warranties

The Platform is provided “as is” and “as available” without any warranties of any kind. We do not guarantee that any Employer will hire you, that any Seafarer will be suitable for a vacancy, or that any match will result in employment. We are not responsible for the conduct, agreements, or actions of any users (Seafarers or Employers).

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or opportunities arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-laws principles. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising out of or relating to these Terms or your use of the Platform.
